INFORMATION MEMORANDUM
TO: State Agencies Administering or Supervising the Administration of Titles IV-B and IV-E of the Social Security Act
SUBJECT: Data Collection for Foster Care and Adoption - Implementation Date
LEGAL AND RELATED REFERENCES: Section 479 of Title IV-E of the Social Security Act
BACKGROUND: Section 479 of the Social Security Act requires that regulations be developed to implement an Adoption and Foster Care Data Collection System by October 1, 1991. On September 27, 1990 the Department of Health and Human Services published a Notice of Proposed Rulemaking in the Federal Register for implementing the required system.
INFORMATION: The final regulations are currently under development but will not be published prior to the required implementation date of october 1, 1991.
Accordingly, until such time as the Department issues a final regulation detailing the requirements and timetable for submitting foster care and adoption data in accordance with section 479 of the Social Security Act, no data will be expected or requested from the States for this purpose. An implementation date will be specified in the final rule.
