INFORMATION MEMORANDUM
TO: STATE ADMINISTRATORS OF STATE PUBLIC WELFARE AGENCIES, CHILD WELFARE SERVICES STATE GRANT PROGRAM (TITLE IV-B OF THE SOCIAL SECURITY ACT
SUBJECT: Apportionment of Funds to States and Territories - Fiscal Year 1986.
CONTENT: Congress has approved for FY 1986 a total of $207,000,000 for the CWS State Grant Program (title IV-B of the Social Security Act - The Act). However, Congress also enacted into law P.L. 99-177, the Balance Budget and Emergency Deficit Control Act of 1985 (popular known as "Gramm - Rudman - Holdings"). Under that act, the amount of funds available for FY 1986 has been reduced by 4.3 percent to $198,099,000. The amount of each State's allotment for the fiscal year has been determined on the basis of that reduced amount and is listed in the attached table.
The legality of P.L. 99-177 is being challenged in the courts. At the present time, the law is being administered as written. Should there be a change in the law's effect and therefore in the amount of funds available under title IB-B, a further transmittal will be issued.
There are no extra requirements for States to meet in order to be eligible for their share of $141,000,000. States meeting the requirements of section 427(a) or 427(b) of the Act are entitled to their share of $198,099,000.
ATTACHMENT: Attached is a State table listing the apportionment of Federal Child Welfare Services State Grant funds for the fiscal year ending September 30,1986 at the $141,000,000 level and at the $198,099,000 level.
ACTION REQUIRED: The apportionment table should be used by the States and Territories in preparing their FY 1986 Annual Budget Request (Form CWS-101). States meeting the requirements of section 427(a) or (b) of the Act should request their full share of $198,099,000 for the year distributed equally over the four quarters. States not meeting the requirements for section 427 funds should request their full share of $141,000,000 spread over the four quarters. States that have requested less than the amount for which they are eligible must send in revised requests in order to receive their full share of funds. If the State's jointly-developed State plan and Annual Summary of Child Welfare Services do not incorporate plans up to the level of their revised request, they must also be revised and submitted. Undersection 428 of the Act and 45 CFR 1357.40, direct grants are being made to eligible Indian Tribal Organizations (ITO's). The amount of their allotments is determined by the amount appropriated and alloted to the States. A separate announcement will be sent to eligible ITO's.
States and Territories should send their ORIGINAL CWS-101's (SIGNED and DATED) to:

A copy of the CWS-101 should be sent to the appropriate regional office, where staff will review the request for completeness and accuracy and will ensure that the State plan and Annual Summary have been approved at the same funding levels before forwarding them to the central office. States should be certain that they have properly signed and dated the documents. If any of the requirements regarding these documents have not been met, Regional office staff will contact the States to take necessary action.
